you have read, understood and accepted these General Terms and Conditions.

ARTICLE 1 - DEFINITIONS
In these General Terms and Conditions the following definitions are applicable:
CONSUMER: The natural person not dealing on behalf of a company or profession and who comes to a distance agreement with Lalu. Also indicated with ‘you’ or ‘your’.
DAY: calendar day
A LENGTH TRANSACTION: a distance agreement related to a series of products and services of which the delivery obligation and the purchasing are spread over a period of time.
DURABLE MEDIUM: any instrument which enables the recipient or Lalu to store information addressed personally to them in a way accessible to future reference for a period of time adequate to the purpose of the information and which allows the unchanged reproduction of the information stored.
RIGHT OF WITHDRAWAL: the possibility for the consumer to terminate the distance agreement within the consideration term.
DISTANCE AGREEMENT: an agreement based on a corporate organized system of distance sales of products and services including the closing of an agreement using one or more techniques of distant communication.
WEBSITE: means our presence on the Internet;
PRODUCT(S): means the good(s) and/or service(s) provided by Lalu including but not limited to our selection of jewellery and design products.

ARTICLE 2 - IDENTITY OF THE ENTREPRENEUR
The Website is managed and maintained by Lalu(“we,” “us” and “our”), with registered office in De Schimmelt 32, 5611ZX Eindhoven, the Netherlands. Lalu is registered at the Chamber of Commerce under number 58484310.

ARTICLE 3 - RELEVANCE
These General Terms and Conditions apply to any offer of Lalu and to every finalized distance agreement between Lalu and you.
Before the distance agreement is concluded, the text of the General Terms and Conditions is being made available to you. If this is reasonably not possible that before the distance agreement is concluded, it will be indicated that the General Terms and Conditions can be seen at www.lalujewellery.com and will be sent to you upon request as soon as possible without extra costs.
If the distance agreement is concluded electronically, notwithstanding the previous article and before the distance agreement is concluded, the text of the General Terms and Conditions can be made available electronically to you in such a way that the text can be saved in a simple way on a durable medium. If this is reasonably not possible that before the distance agreement is concluded it will be indicated where you can find the General Terms and Conditions electronically and that these General Terms and Conditions at your request will be sent electronically or otherwise to the consumer without extra cost.
For the case that besides these General Terms and Conditions, specific product and service conditions are also applicable, and in case of conflicting General Terms and Conditions you can appeal on the relevant General Terms and Conditions which are the most favourable for the consumer.

ARTICLE 4 - OFFER
If an offer has a limited validity or has other specifications, this will be emphatically mentioned.
We have taken care with the descriptions and specifications of our products and to reproducecolours and styles accurately on our website, although some variation may occur. The images used by Lalu are true representations of the products and services. Obvious mistakes and errors do not bind us.

ARTICLE 5 - PRICE
When you submit your Order, you are offering to buy the Product(s) at the price set out in the Offer. All prices are inclusive of 21% VAT.  Shipping costs (where applicable) and any import duty and taxes incurred will be added to the total amount due when you view the Product(s) in your Shopping Bag. The total cost for the Product(s) and Delivery Charges will be displayed before you confirm your Order and will be set out in the confirmatory email you receive from us.
Our prices may change at any time. If we discover that the price has changed or that there has been a pricing error when we receive your Order we will contact you as soon as possible and ask if you wish to proceed at the correct price. If you confirm that you do wish to proceed, please remember that we will still not be under an obligation to supply the Product(s) until we have sent you the second email confirming your Order.

ARTICLE 6 - ENGRAVING & GIFT MESSAGES
Please note that we are unable to process any engraving order or gift card messages using profanities or inappropriate language which may be submitted as part of your Order. Where possible, we will contact you to seek an alternative engraving or gift message and this will be done before we send you the second confirmatory email in respect of your Order.

ARTICLE 7 - THE AGREEMENT
The agreement is finalized, subject to the provisions in paragraph 4, at the moment that you accept the offer and meet the conditions.
If you have accepted the offer electronically, we immediately confirm electronically that we have received the acceptance of the offer. As long as we have not confirmed the acceptance, you can terminate the agreement.
 If the agreement is concluded electronically, we will take appropriate technical and organizational measures to protect the electronic data transfer and we will ensure a safe web environment.
We can notify or check, within the legal framework, if you can meet the payment obligations, and also check all important facts and factors which are needed to finalize a sound distance agreement. If we, based on research, have good reasons not to conclude the agreement then we are entitled to motivate and to refuse an order or we can connect special conditions to the execution of the offer.

ARTICLE 8 - RIGHT OF WITHDRAWEL
After purchasing products you have the possibility to disband the agreement without giving reasons during 14 days. The cooling off period starts on the day after you have received the product or a pre-designated representative by the consumer made known to Lalu.
During the cooling off period the consumer shall treat the product and the package carefully. You shall unpack or use the product only to the extent to, and as far as it is necessary to judge if you wish to keep the product. If you do want to execute the right of withdrawal, you shall return the product with all accessories and in the original conditioning and packaging to us, in accordance with our Return Policy.

ARTICLE 9 - WITHDRAWEL COSTS
If the consumer executes the right of withdrawal, he will have to pay no more than the costs of returning the product.
If the consumer has made a payment, Lalu shall pay back this amount as soon as possible but no later than within 30 days after the repeal or after the return shipment.

ARTICLE 10 - CONFORMITY & GUARANTEES
All products supplied by Lalu are warranted free from defects in workmanship or materials for a period of 6 months. This warranty does not affect your statutory rights as a consumer.
This warranty does not apply to any defect in the products arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than in accordance with our instructions, or any alteration or repair carried out without out approval.
If the products supplied to you develop a defect while under warranty, or you have any other complaints about the products, you should contact us. Please refer to our Return Policy for more information regarding repairs.

ARTICLE 11 - DELIVERY & EXECUTION
We shall observe in utmost care the reception and execution of orders of products and when assessing applications for services.
The address that has been made known by you to us is considered to be the delivery place.
Taking into account what is stated in article 4 of the General Terms and Conditions, Lalu shall execute the accepted orders expeditiously but not later than within 10 days unless a longer period has been agreed. If the delivery is delayed or if a delivery cannot or partially be executed, you are notified about this no later than 10 days after he placed the order. In that case, you have the right to terminate the agreement without any further cost.
In the event of termination in accordance with the previous paragraph Lalu shall pay back the amount that you have paid as soon as possible but no later than 30 days after the termination.
If the delivery of an ordered product appears to be impossible, we shall strive to make available a replacement product. At least before the delivery it will be mentioned in a clear and understandable manner that a replacement product will be delivered. The right of withdrawal cannot be ruled out with regard to replacement products.
The risk of damage and/or loss of products rest with Lalu until the moment of delivery at the consumer or a pre-designated and an announced representative to the entrepreneur, unless otherwise expressly agreed. If you receive a damaged product, you can return this to us by following the steps written in our Return Policy

ARTICLE 12 - PAYMENTS
The purchase price for the products ordered by you is due upon the shipment of your order by Lalu. Upon shipment, we will charge the credit card account you identified when your order was placed for the purchase price, the cost of shipping and handling and applicable taxes. You may not make any set off against our claim for payment unless the amount set off is not disputed by Lalu or has been the subject of a final and binding judgment against us
In case of default by the consumer Lalu has, subject to legal restrictions, the right to charge the reasonable costs which are made known to the consumer in advance.

ARTICLE 13 - COMPLAINTS
lalu features a sufficiently publicized complaints procedure and handles the complaint according to this complaints procedure.
Complaints about the execution of the agreement must be described fully and clearly within reasonable time submitted to us after the consumer has observed the defects.
The complaints submitted to Lalu will be answered within a period of 14 days from the day of receipt. If a complaint has a foreseeable longer processing time, we will answer within 14 days an acknowledgement and an indication when you will receive a more detailed answer.
If a complaint cannot be resolved by mutual agreement then there is a dispute that is subject to the dispute settlement.

ARTICLE 14 - DISPUTES
When consumers have a problem with a trader regarding a product or service they bought, they can settle their dispute out-of-court through an Alternative Dispute Resolution procedure. Such procedures are an alternative to resolving disputes before a court and are hence called Alternative Dispute Resolution (ADR). When they are carried out online, they are called Online Dispute Resolution (ODR). The ODR platform is a web-based platform developed by the European Commission. Its objective is to help consumers and traders resolve their contractual disputes about online purchases of goods and servicesout-of-court at a low cost in a simple and fast way. ARTICLE 15 - ADDITIONAL & DIFFERENT PROVISIONS
Additional or different provisions compared to the General Terms and Conditions may not be to the prejudice of the consumer and should be recorded in writing in such a manner that the consumer can save these in an accessible way on a durable medium.

✧ BRACELET SIZE GUIDE 

Although a bracelet that is sliding off is annoying, it is way better than a bracelet that is too snug, because this can even be dangerous. So when placing an order, please keep in mind that a bracelet needs to be slightly loose. This means that the bracelet is roughly 2,5 – 3,5cm (1-1.5 inch) larger than your wrist measurement, depending on what is most comfortable for you. As we want to let women of all sizes enjoy our jewellery, we’ve made sure that our bracelets are adjustable in size, covering the most common sizes (18 cm / 7”). Please check the product details to find out the exact measurements. 

HOW TO MEASURE
♥  The best way to determine the required length to order, is to measure a bracelet you own in a similar style. If the measured length is between sizes, we suggest that you round up to the next largest size.
♥  Another method is to wrap a soft measuring tape or ribbon snugly (but not too tightly) around your wrist, just below your wrist bone. Mark the length (cutting and/or measuring the ribbon with a ruler) and add 2,5 – 3,5cm (1 to 1.5 inches). This is your bracelet size. Use that measurement as a guide to ordering the closest length available in the style of your choice. If your wrist is between sizes, we suggest that you round up to the next largest size.

The sizing of children’s jewellery is really dependant on the size of the child rather than the age as children do vary so much. A small toddler can have chubbier wrists than a beanpole of a young teenager!
If you can it is a good idea to try to measure the child’s wrist before purchasing. A game with a length of string or ribbon usually does the trick. All children love to be measured to see how big they are getting!  As a general rule, for a comfortable fit, you should allow an extra 1-2 cm depending on the overall length. We’ve made sure that our bracelets include extender chains ( 3 cm /1, 2 inch), so that girls can grow into their jewellery, and hopefully be able wear it for a few years. Nothing is  as annoying as a ring that is spinning around your finger, barely hanging on to your knuckle when reaching down. However a ring that is so tight it cuts off the blood supply to your fingertip, isn’t really comfy as well.To avoid these jewellery annoyances, please make sure you order the right size by following the guidelines below.

As most of us are probably aware of, our finger size can change throughout the day. When it is cold our fingers can easily be half a size smaller. We want the ring to be comfortable enough when your fingers are at their largest, so the best to do is to measure at the end of the day in normal room temperature.If the ring has a thick band or if you’re stacking up a few rings, the band(s) will feel tighter than a thin band. In these cases we advice buying a size larger than your normal size. When buying a gift, you’ll need to channel your inner sneak-thief by “borrowing” her ring (from the correct finger) and using the ring size guide below to determine its size.

HOW TO MEASURE

♥  Take a ring you/she already own(s) and measure the diameter, to be certain also measure the circumference, and determine the size with the help of the schedule below.
♥  Measure the length of the thread with a regular ruler in mm; Take the tip or end of a sewing thread and wrap it around your finger until it meets or connects together. Then mark that position of the material, measure it and use that measurement as a guide to ordering the correct size.
